   Welcome to SkyWatch! These Terms of Service ("Terms") govern your use of our software-as-a-service platform (the "Service") provided by Inspectlogs OPC Private Limited ("we," "us," or "our"), a company established in 2020 under the laws of India. SkyWatch is a frontend observability platform that enables you to monitor errors, replay user sessions, track performance metrics, and gain AI-driven insights to optimize your applications. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. 2. Eligibility

   You must be at least 18 years old and have the legal capacity to enter into these Terms to use the Service. By using SkyWatch, you represent and warrant that you meet these eligibility requirements. Additionally, you must comply with all applicable laws in your jurisdiction when using the Service.

3. 3. Account Registration

   To access SkyWatch, you must register for an account. You agree to:

   • Provide accurate, complete, and up-to-date information during registration.
   • Keep your account credentials secure and not share them with others.
   • Be responsible for all activities that occur under your account. We reserve the right to suspend or terminate your account if we suspect unauthorized use or a violation of these Terms.

4. 4. Subscription and Payment

   SkyWatch offers tiered subscription plans (Free, Pro, and Enterprise) as described on our pricing page:

   • Free Plan: Includes access to all features, 5,000 session recordings per month, 15-day data retention, and email support.
   • Pro Plan: Includes 10,000 session recordings per month, 90-day data retention, additional session recordings at $0.0025 each, and email and chat support, starting at $49/month (or discounted for annual billing).
   • Enterprise Plan: Offers custom session recording limits, custom retention periods, audit logs, role-based access controls, single sign-on (SSO), and priority support, with pricing available upon request.
   Subscriptions renew automatically unless canceled before the renewal date. You agree to pay all applicable fees as outlined on the pricing page. All payments are non-refundable except as required by law or explicitly stated in our refund policy. We may update pricing at our discretion, and changes will apply at the start of your next billing cycle.

5. 5. Service Features and Usage

   SkyWatch provides tools to monitor errors, replay user sessions, track performance metrics (e.g., Core Web Vitals, page load times, API response times), generate heatmaps, and deliver AI-driven insights. You may use these features solely for the purpose of monitoring and optimizing your applications. Specific usage limits (e.g., session recordings, data retention) depend on your subscription plan.

6. 6. Acceptable Use Policy

   You agree to use SkyWatch only for lawful purposes and in accordance with these Terms. You may not:

   • Use the Service to monitor applications that violate any laws, including privacy or data protection laws in your jurisdiction.
   • Attempt to reverse-engineer, hack, or interfere with the Service’s functionality, including its AI algorithms or session replay technology.
   • Use the Service to collect or process sensitive personal data (e.g., financial or health information) without proper legal basis or user consent.
   • Overload or misuse the Service in a way that impacts its performance for other users (e.g., excessive API calls beyond your plan’s limits).
   • Use the Service to engage in fraudulent, abusive, or harmful activities, such as spamming or harassing others. Violations of this policy may result in suspension or termination of your account.

7. 7. Data Collection and Session Recordings

   SkyWatch collects data from your applications, including user session recordings, error logs, performance metrics, and device information, to provide observability and analytics. You represent and warrant that:

   • You have obtained all necessary consents from your end users to collect, process, and share this data with SkyWatch, in compliance with applicable privacy laws (e.g., GDPR, CCPA).
   • You have informed your users that their interactions may be recorded and analyzed for observability purposes. We store this data for the retention period specified in your subscription plan (e.g., 15 days for Free, 90 days for Pro, or custom for Enterprise). After this period, data is automatically deleted unless otherwise required by law.

8. 8. AI-Driven Insights

   SkyWatch uses artificial intelligence (AI) to provide insights, such as error prioritization and performance optimization recommendations. You acknowledge that AI-generated insights are provided "as-is" and may not always be accurate. We are not liable for any decisions you make based on these insights.

9. 9. Intellectual Property

   We retain all rights, title, and interest in SkyWatch, including its software, AI algorithms, design, and branding. You retain ownership of any data or content you upload or generate through the Service ("User Data"). By using SkyWatch, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your User Data solely to provide, maintain, and improve the Service. You also grant us the right to use anonymized and aggregated data derived from your User Data for analytics and product enhancement purposes.

10. 10. Privacy

    Your use of SkyWatch is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information and your end users’ data. You are responsible for ensuring that your use of SkyWatch complies with all applicable privacy laws, including obtaining consent from your end users for session recordings and data collection.

11. 11. Termination

    We may suspend or terminate your access to SkyWatch at our discretion, with or without notice, if you violate these Terms or engage in activities that harm the Service or other users. You may cancel your account at any time through your account settings. Upon termination:

    • Your access to the Service will cease.
    • Any remaining data will be retained for the duration of your plan’s retention period and then deleted.
    • No refunds will be provided for unused subscription periods.

12. 12. Disclaimers

    SkyWatch is provided "as-is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or uninterrupted operation. We do not guarantee that the Service will be error-free, secure, or available at all times. Session replays, performance metrics, and AI insights are provided for informational purposes and may not always reflect real-time or accurate data.

13. 13. Limitation of Liability

    To the fullest extent permitted by law, Inspectlogs OPC Private Limited shall not be liable for any indirect, incidental, or consequential damages arising from your use of SkyWatch, including but not limited to loss of data, revenue, or profits. Our total liability to you shall not exceed the amount you paid us in the last 12 months.

14. 14. Governing Law and Dispute Resolution

    These Terms are governed by the laws of India. Any disputes arising from these Terms shall be resolved through arbitration in Pune, Maharashtra, in accordance with the Arbitration and Conciliation Act, 1996. If arbitration is not applicable, disputes shall be resolved in the courts of Pune, Maharashtra, and you agree to submit to the jurisdiction of those courts.

15. 15. Changes to the Terms

    We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of SkyWatch after such changes constitutes acceptance of the updated Terms.
